Terms and Conditions 

TRADE STALLS (Food & Non-Food)

TERMS AND CONDITIONS IN ACCORDANCE WITH FOLKESTONE FILM, TV AND COMIC CON CONDITIONS

 

By submitting an application form to trade at FFTCC you are legally binding yourself to abide by our terms and conditions of trading.

Please ensure you have read them and made your staff aware of them prior to the event. (Terms are available at our website and sent in traders packs before the event).

The management reserves the right to evict from site anyone breaking this contract, or behaving in an illegal, aggressive or disorderly manner.

You will be informed if you have been successful by email. All bookings are non-refundable after the 1st January of the year of the event. Full payment is required within 30 days of your invoice being sent to secure the pitch.

Applications are accepted on the assurance that the merchandise described on the form is all that will be sold on your stall at the Convention. Please give a thorough description as this is a large factor in how we base our decision on who we invite to trade. The  event will not accept liability for any loss or damage to persons or equipment.

 Any stall not complying with the accepted standards and fire regulations will be closed down and all staff will required to leave. All mobile caterers and non-food stalls must comply with the requirements of the Food Safety (General Food Hygiene) Regulations 1995, Food Safety (Temperature Control) Regulations 1995, The Food Safety Act 1990, and both the Health and Safety at Work Act 1974 and Management of Health and Safety at Work Regulations 1999 as applicable. In respect of Fire Safety all Traders must comply with the Regulatory Reform (Fire Safety) Order 2005 as well as adhering to more specific HSE Guidelines for Work Process Fire Safety. All electrical equipment will carry PAT/electrical safety certification; this must be available for inspection at the event. As far as practicable, all electrical equipment shall be located so that it cannot be touched by members of the public or unauthorised workers.

Unless specifically agreed with Planet Folkestone, generators are not allowed. Onsite power will be made available and details will be provided if your application is successful. All tents or other self-build structures should be of sound construction including all supporting poles, frames, guy ropes, stakes anchors and fastenings etc. and all guy ropes and fixing stays shall be conspicuously marked to ensure they do not present a trip hazard. Construction of such temporary structures must comply with the MUTA (www.muta.org.uk) Best Practice Guide where applicable and inspection on site may be subject to the guide’s ‘Recommended minimum checklist for assembled structures’ at the discretion of Planet Folkestone. Non-compliance may result in closure of the stall

You will be allocated a set number of numbered wristbands (2 per trader) which must be carefully worn by yourself and your staff at all times on site. Any broken, incomplete or loose wristband will not be considered valid and will be removed, along with the wearer, by security.

The sale of alcohol, weapons, wax flares, sky lanterns, bootleg and merchandise are all banned. Anyone to be found breaching the licensing laws will be removed from site immediately and prosecuted.

SET UP Details will be sent in your traders information pack and MUST be adhered to. The management reserves the right to change set up times as necessary.

Once sited you must stay within the Pitch boundary and may under no circumstances move your pitch without express permission from Planet Folkestone Organisers. Failure to comply will result in your being asked to re-position your stall or to leave the site. Anyone found to be using or selling illegal drugs will be immediately shut down, and reported to the authorities.

ALL Traders must take any excess waste away with them upon leaving site or place in bins provided. You may not sell goods from any area other than your designated pitch, sell goods other than those indicated on your application, or trade outside of the designated trading hours, as this will constitute illegal trading, and you will be closed down. Unauthorised use of the Planet Folkestone or Folkestone Film, TV and Comic Con logo is strictly prohibited.

Designated trading hours are 10am to 4pm.

You may not sell drinks in glass containers.

Smoking is NOT ALLOWED inside the venue.

Traders may under no circumstance sub let all or part of their pitch.

Your signature/email confirming request for a pitch is a contract between YOU and the Planet Folkestone.

Each stall is to be responsible for the cleanliness of their pitch, both back and front, including the public area immediately in front of your stall.

In the event of a cancellation by the trader after payment, the total cost paid for the pitch will be forfeited if cancelled after the 1st January (the year of the event).

In the situation that the event is cancelled, Planet Folkestone cannot be found liable for consequential loss.

All prepaid monies will be returned.

The decision of a member of Planet Folkestone Staff is final.

PUBLIC TERMS AND CONDITIONS (Attending the event)

Your use of this site is subject to the following Terms and Conditions. By contacting us and ordering tickets you confirm that you have read and accept the Terms and Conditions in their entirety.

Terms and Conditions

1. Contract

1.1 A legally binding contract will come into existence when we accept your order.

1.2 Acceptance of an order placed by you is subject to the condition that tickets are available for the event selected by you.

1.3 We will notify you by email if we accept your order. Acceptance will be deemed to have been effectively communicated to you when we send the email (whether or not you receive such communication).

1.4 No order will be accepted until we have received full payment for the cost of the tickets plus booking charges and where applicable postage and VAT.

1.5 Once purchased, tickets cannot be transferred, exchanged, refunded or returned.

1.6 If FFTCC is cancelled we will make notification by posting on the relevant events website.

1.7 If FFTCC is moved to another date we will make notification by posting on the relevant events website, we suggest that you always check the website before you begin your journey.

2. Price and Dispatch

2.1 Tickets will be dispatched to the email address given when the order is placed.

2.2 Customers are advised to check their purchase upon receipt and inform us of any errors as soon as possible.

2.3 It is the responsibility of the customer to inform us of any change of address, contact number or email address, both before and after the receipt of goods.

2.4 No duplicate tickets will be issued to replace lost or stolen tickets unless suitable reason is given and accepted by the Planet Folkestone who have full and final decision.

2.5 If a customer orders more tickets than the maximum allowed as indicated during the booking process, we reserve the right to cancel the order.

2.6 We will not be responsible for failure of any delivery services employed to deliver on time.

3. Performances

3.1 The right to refuse admission to an event is reserved by the Planet Folkestone at all times and/or event venue, who may take health and safety, environmental and security concerns into account at their reasonable discretion and may from time to time carry out security searches.

3.2 We would advise customers that no refunds will be offered to customers who are refused entry or ejected from a venue on account of  being or appearing to be under age, declining to be searched, abusive, threatening, drunken or other anti-social behaviour (including smoking in no smoking areas), carrying offensive weapons or illegal substances, Full rules for photography are available on our website.

3.3 All guest appearances are subject to work and personal commitments.
4. Liability

4.1 In all arrangements involving third parties we act only as your agent and no liability of any kind whatsoever shall be attached to us in connection with or arising from such an arrangement with a third party.

4.2 We do not accept any liability for any losses or claims arising from any inability to access our website or any failure to complete a booking on the website.

4.3 We do not accept liability for any indirect or consequential loss of any kind in contract, tort or otherwise arising out of the use of the website or the purchase of the tickets or other goods or services from us by whatever means.

4.4 Whilst every care is taken to ensure tickets or other goods or services ordered by you arrive on time at the agreed destination, we do not accept liability for loss or damage that is caused by any event or circumstances beyond our reasonable control.

4.5 To the fullest extent permitted by law we will not be responsible for loss, damage or injury to any person or their property howsoever caused.

5. Special Circumstances

5.1 No tickets need to be purchased for children under five years of age.

7. Use of our Website

7.1 We reserve the right to update or otherwise change the terms and conditions or amend the website at any time and without notice to you.

7.2 We will not accept any liability for tickets or other goods and services which have been ordered through our website or bought at the event using your credit/debit card by someone not authorised to do so.

7.3 Our website uses industry standard encryption software and a secure server to ensure the safety of orders placed on our website. No one can access any information sent by you as long as it is sent using the secure pages. Therefore you must only send your credit/debit card details where asked for on our website and you must not send credit/debit card details by standard email.

8. Invalidity

8.1 If any part of these conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

9. No Waiver

9.1 No failure or delay on the part of any parties to these conditions relating to the exercise of any right, power, privilege or remedy provided under these conditions shall operate as a waiver of such right, power or remedy.

10. Governing Law

10.1 These Terms and Conditions and our agreement with you under them shall be governed by English Law, and we agree to submit to the exclusive jurisdictions of the English Court for the determination of any dispute between us.
